$975,000 SETTLEMENT IN 2020

In 2020, Adam obtained a settlement in the amount of $975,000 against an insurance company that refused to defend and indemnify a building owner in a premises liability lawsuit.

FAVORABLY RESOLVED CITY'S INSURANCE DISPUTE

In 2020, Adam was hired by a local Municipality to handle an insurance bad faith situation. His involvement saved over $200,000 for his client and ended a 2 1/2 year dispute in a few months. In an address to the City Council, the City's  Mayor described Kutinsky as the "game changer."

OBTAINED COMPLETE DISMISSAL AGAINST INSURER 

In 2011, Adam defended a business in complex litigation involving unusually rare insurance law issues.  He obtained complete dismissal of the multi-count lawsuit for his client.

ERISA Plan Decision

In 2024 Mr. Kutinsky represented an ERISA plan participant who was denied benefits under his employer health plan following a serious dirt bike accident. The US District Court reversed the plan administrator's decision finding it was "arbitrary and capricious" and awarded full benefits. 

WON COMPLEX CASE INVOLVING TITLE INSURANCE

In 2017, Adam was hired by the largest title insurance company in the country to handle litigation involving unusual legal issues. He won the case outright which was appealed by the other party and upheld.

$550,000 JUDGMENT FOR
NURSING HOME

Obtained a $550,000 Judgment against an insurance company that refused to pay for substantial storm damage to a nursing facility.

OBTAINED OUTSTANDING VERDICT AT TRIAL IN 2017

In 2017, as defense trial counsel to one of the largest public universities in the United States, Adam successfully tried a high exposure case to verdict in the Michigan Court of Claims. At trial, the plaintiff claimed more than ten million dollars ($10,000,000) in economic damages, but received a verdict of zero dollars ($0) in economics.
